Covered decks in Portland

A covered deck is a deck with a roof over it, which in Portland’s wet months is the difference between a deck you look at and one you can sit out on. Attached or freestanding?

An attached deck cover is fastened to the house at one side and carried on posts at the other, usually as an extension of the roof line or just below it. It shares the house wall, so how it connects to the house and sheds water away from it are the details to ask about. A freestanding cover stands on its own posts and beams, so it can sit over a deck away from the house, but it needs its own footings throughout.

Whichever you choose, the cover is a structure in its own right: the deck below has to be able to carry its posts, or the posts need footings of their own.

Deck cover permits in Oregon

Covers have their own line in the state’s permit exemptions, separate from the 30-inch rule for decks. Chapter 1 of the 2026 Oregon Residential Specialty Code (R105.2), mandatory since October 1, 2026, exempts:

“Deck, patio or porch covers as defined in Section BF102, not more than 200 square feet (18.58 m2) in floor area and not closer than 3 feet (914 mm) to lot lines.”

So a cover larger than 200 square feet, or one within 3 feet of a property line, needs a building permit, even over a deck low enough not to need one. Cities then add their own layers:

  • Portland: the City’s deck guidance says of covered decks, “Regardless of height, you will need to follow additional zoning requirements,” and its plan requirements state that covered decks must follow setback rules.
  • Oregon City: permits from both the Planning and Building divisions are required for decks covered by a roof or canopy over 200 square feet or more. The city publishes a separate guide to building a cover for a deck or patio. See deck builders in Oregon City.
  • Tigard: the low-deck setback allowance applies only to unroofed decks, and the City’s exemption for covered porches and decks requires them to stay at least 3 feet from the property lines.

Roof options

Most deck covers use one of three kinds of roof:

  • a solid roof, framed and roofed to match or complement the house;
  • translucent panels, such as polycarbonate, which keep the rain off but let light through to the windows behind the deck;
  • a louvered system, whose slats open for sun and close for rain.

Do I need a permit to build a patio or deck cover in Oregon?

Only a small cover set back from the property lines is exempt. The Oregon Residential Specialty Code exempts porch, deck and patio covers of not more than 200 square feet that are not closer than 3 feet to lot lines; anything larger or closer needs a building permit. Cities can add zoning rules on top, and Portland applies zoning requirements to covered decks at any height.

Oregon's residential code calls it a deck, patio or porch cover, depending on what it shelters. A roof over a deck is a deck cover in the code's terms, whatever it is called on a plan or in a quote.

Does a covered deck in Oregon City need a permit?

Oregon City requires permits from both its Planning and Building divisions for decks covered by a roof or canopy over an area of 200 square feet or more, as well as for any deck more than 30 inches above the ground.
