Happy Valley’s deck engineering rule
The City of Happy Valley’s policy POL 13-108, “Deck Engineering”, is short and specific:
“Requires engineering on any deck ten (10) feet or more feet in height.”
On a sloping lot, the height of a deck at its low side can reach 10 feet even when it sits level with the back door. Once it does, the deck needs engineering rather than the code’s standard prescriptive details. For a new home, the policy also sets the timing: “The engineering must be submitted and approved prior to the framing inspection on the home.”
Below 10 feet, the state rules apply as everywhere else in Oregon: a deck whose walking surface is more than 30 inches above grade needs a building permit, and guards at least 36 inches high once it is more than 30 inches above the ground below.
