Two permits, and a rule for covered decks

The City’s “Build a Deck” page states:

“Permits from the Planning and Building Divisions are required for all decks over 2.5 feet (30 inches) above the ground or decks that are covered by a roof or canopy for an area of 200 square feet or greater.”

Two things follow. A deck above 30 inches needs a planning review as well as a building permit, and the City’s guide encourages submitting the Planning and Building applications at the same time. And a covered deck of 200 square feet or more needs both permits even if the deck itself is low. Setbacks by zone

Oregon City’s guide, “Constructing a Deck or Patio at your Home”, says the requirements come from Title 17 of the Oregon City Municipal Code and Section 105.2 of the Oregon Residential Specialty Code, and that:

“All decks and patios over 2.5 feet (30 inches) in height (at any point) shall be separated (setback) from the property lines.”

The distance depends on the zone. In the guide’s table, porches, decks and covers over 30 inches in the R-10 zone must be 15 feet from the front and rear property lines; in R-3.5, the front setback is 0 feet and the rear 10 feet. The guide also warns that construction on properties “with or near streams, steep slopes, landslides, high water tables, floodplains or historic structures may be reviewed in more depth.”

The Oregon City Building Division at City Hall, 625 Center Street, Oregon City, OR 97045 (503-722-3789). Clackamas County lists Oregon City among the cities that do their own structural review.
